Courier man smashed my cooker?
I got the bargain of a life time on ebay when I bought a double oven range cooker, stainless steel, a real cracker. It was 230 miles from me so I booked a courier. The courier arrived only to tell me it had tipped over and it has smashed both glass doors, dented 2 panels and dented the stainless back splash. I reckon it would be 3-£400 to repair. Now I know I won't get another bargain like this, My question is, does his insurance pay me what I paid for the cooker or do they have to pay for the cost of repair. I don't wont a profit, just my cooker as it was. Thanks.

I would claim for a replacement cooker to the same specification, preferably the same model. Do not claim for what you paid, claim for the value of the cooker in the condition in which the courier picked it up from the seller. Alternatively, you could get a proper quote for repairs and make this the basis of your claim. Also you would need to know any insurance details in the company's contract.

- The courier' insurance has the option of either repairing or salvaging, depending on the cost of repairs vs payment for a replacement cooker. If they elect to salvage (not repair) the unit, they should pay you not what YOU paid, but should pay current market value.
- What you paid should be irrelevant. Their insurance should either pay for a repair or for the cost of a replacement, whatever that may be.
- Its down to the insurance company. Repair it or replace it. Or give you a full refund of what you paid for it.
- They have to return the cooker to its original condition which may entail buying another second hand one .Insurance companies do use sites like Ebay to determine the value of used items so even if you got an absolute bargain you should be able to buy a similar cooker through e-bay with the settlement that they decide on . You could of course being the injured party demand they repair the cooker Ie new glass new splash back and replacing any other damaged parts.It is up to you to decide what you want to do but bear in mind the insurance company will probably offer a ridiculously low first settlement and it may take some time to get what you want.
