my nan passed away a couple of weeks ago of cancer, her life insurance will pay out to cover her funeral costs and should go to my mum who has been her sole carer for 5 years but before they will release funds they are asking for my grandads Signature, although they are not divorced they are separated and not on good terms. is there anyway around this? she did not want him to know she was poorly let alone that she has now passed away. please help!

If they are asking for a signature from your grandfather, that likely means he is listed as the beneficiary. The beneficiary has first dibs on the money and that is undisputable. Even a Will can't turn that over. It's been tried before and it's never been successfully challenged and overturned.

Next of kin means nothing if there is a beneficiary listed. The beneficiary gets it, done deal.

If no beneficiary is listed it will go to the estate and the money will be distrubuted as detailed in the Will. The key in this case is that Will's are public record AND contestable in court. If this is the case with you, where no beneficiary has been listed, you can challenge the Will in court and plead your case that your mother should be getting the money.

  • I'm assuming you're in the UK. If she left a will, the money would go to her executor. If she didn't your Mum could apply to the Probate Office for letters of administration and she could collect the money as administrator. Where's there's not much money involved, an insurance company will usually pay out to the next of kin without the need to go to probate. Unfortunately, her next of kin is your Granddad, and without probate, the money goes to him to do what he likes with it. You will need to contact him to see if he will agree to the money being used for funeral expenses. If you don't, he could sue you for delaying his money by not telling him your Nan has died.
  • Strictly speaking, the money should go to your grandad as next of kin. Your mother is not entitled to it simply because she was the carer. You say your nan and grandad were not on good terms, but presumably you and your mum get on alright with him. Even if not, my advice would be that either you or your mum speak to your grandad to see if he will agree to your request. I can see no other way around it because it's definitely his money.

I am 72 years of age and wish to have a holiday in Canada, I have discovered that my 'Travel Insurance' wil be DOUBLE someone of 62 years. I work out at a gym twice a week and jog every day (about 4 miles) Isn't doubling my insurance because of my age illegal and ageism discrimination?

If You are in the U.K. I would recommend Direct Line, I have pre existing medical condition, I have always found them reasonably priced on travel insurance !

Courier man smashed my cooker?

I got the bargain of a life time on ebay when I bought a double oven range cooker, stainless steel, a real cracker. It was 230 miles from me so I booked a courier. The courier arrived only to tell me it had tipped over and it has smashed both glass doors, dented 2 panels and dented the stainless back splash. I reckon it would be 3-£400 to repair. Now I know I won't get another bargain like this, My question is, does his insurance pay me what I paid for the cooker or do they have to pay for the cost of repair. I don't wont a profit, just my cooker as it was. Thanks.

I would claim for a replacement cooker to the same specification, preferably the same model. Do not claim for what you paid, claim for the value of the cooker in the condition in which the courier picked it up from the seller. Alternatively, you could get a proper quote for repairs and make this the basis of your claim. Also you would need to know any insurance details in the company's contract.

  • The courier' insurance has the option of either repairing or salvaging, depending on the cost of repairs vs payment for a replacement cooker. If they elect to salvage (not repair) the unit, they should pay you not what YOU paid, but should pay current market value.
  • What you paid should be irrelevant. Their insurance should either pay for a repair or for the cost of a replacement, whatever that may be.
  • Its down to the insurance company. Repair it or replace it. Or give you a full refund of what you paid for it.
  • They have to return the cooker to its original condition which may entail buying another second hand one .Insurance companies do use sites like Ebay to determine the value of used items so even if you got an absolute bargain you should be able to buy a similar cooker through e-bay with the settlement that they decide on . You could of course being the injured party demand they repair the cooker Ie new glass new splash back and replacing any other damaged parts.It is up to you to decide what you want to do but bear in mind the insurance company will probably offer a ridiculously low first settlement and it may take some time to get what you want.

I've no idea, but a 1 year old laptop will almost certainly not be worth insuring, beyond the cover you will get with your household contents insurance.

  • The smart way is not to insure it. Get quotes if you can, on a new one if necessary. Then save the same amount of money to a mini cash ISA by standing order. That way you will have money to repair it if needed. But more than likely you will have a tidy sum saved as they rarely go wrong.

As far as I know in the UK you have to be at school until you turn 16 but you can work evenings or week-ends if you want to.

I believe that there are limits as to the hours you can work (not after midnight for example) and the types of work that you can do (not in public houses or clubs) but apart from that I think you are ok.

I bought a mattress, then cancelled the order and bought one from somewhere else (they could ship it to me quicker). The order cancellation was confirmed and I was refunded, but then today the mattress arrived that I'd cancelled. It's from a very large company...shall i call to have it returned, or just keep it? :)

  • You need to call them and let them know. Ask them to make arrangements to pick up the mattress. If they don't do this then send them a letter asking them again and make sure that they have to sign for the letter. Keep a copy for yourself. If they don't pick it up after a reasonable amount of time and you can prove you asked them to then it will become your mattress. In the meantime don't unwrap it or use it.
  • I would advise that you call the company and asked them to collect the goods. You are legally bind to return the goods. Company can take legal action if you keep the goods and also desecration of company. Also that mattress is not belongs to you and can be considered as stolen goods and may be prosecute to you.
  • Advise the company in writing that you have the cancelled goods. Keep a copy of your letter and send recorded delivery (if in the UK). If you keep the goods, which i presume where signed for, without advising the company concerned they may charge you for them again if you paid by credit/debit card. After allowing a reasonable time for the goods to be collected, say six months, i would assume the goods were mine.
  • Phone the company and ask them what to do..
    You have a 50 -50 chance that the price of re-collection and re-selling a now 'used' (even if you haven't) item out weighs just giving it you, so they might just tell you to keep it.

    Do the right thing, or the universe might bite you on the ***... or reward you as an honorable person.
  • Call them, give them the confirmation number of your cancellation, and ask them when they will have it picked up. Double check your credit card account to make sure that it has been cancelled.
  • If you signed for it then keeping it will get you charged for it as it is classed as you accepted the goods. You need to ring the company and get them to arrange collection at their expense.
  • Call them to have it returned.
  • Return it ,call them and they will collect it back from you.

I am thinking of buying a house on which an insurer has previously paid out for a movement claim.The insurer has since monitored the house and there has been no further signs of movement.If there was to be further movement is it likely that the insurer would refuse further renewals or increase the premium by an unpallitable amount?

If there has been subsidence it is quite possible you won't even get a mortgage.

But if you do the insurance premium will be higher than it would otherwise have been. All premiums are based on the risk involved, and there is clearly a higher risk in this property than in others.

I'm about to book a trip in feb on the Ferry Hull-Zebrugge. I'm looking at travel insurance and they say stuff about cancelled trips but I think a ferry would probably still go in snow but its if we cant get to Hull, I'd want my money back. Would this be likely?

depends on the policy
if you coudl demonstrate that you took all reasonable steps to make the journey then I woudl expect the policy to payout. reasonable is a flexible term. but it would npt cover you if say it you did not take into account weather when planning to leave. so if there was a weather warning out from the met office and you decided not to take extra time to travel then I doubt you will be covered. if you left your home to arrive at the ferry port at the alst possible minute I'd be surprised if you were covered.

if you have any doubts then raise those question prior to buying the policy. if you do that by phone take note of who you speak t, when you spoke to them and waht was said. if its critical record the conversation.

in essence its up to you to make certain the policy you buy provides adequate cover. not all travel, or for that matter any, insurance policies provide the same cover.

Although I doubt very much that you would get any money back ... they will probably specify a certain amount of snow or say that you would have known about the bad weather and should have travelled earlier or something like that! They always have a way out to avoid paying out.

    I was delayed in Singapore a couple of years ago through the fault of some woman going into labour on the plane to the UK so we had to turn back. She lied and said she was 25 weeks pregnant when she was more than 35 weeks.

    Anyway, British Airways said that we would all receive a letter for our travel insurance companies saying that we were delayed through no fault of our own. When the letter arrived it stated that we were delayed 23 hours and 56 mins - our travel insurance stated that they would pay out on 24 hours!

    Have never travelled with BA ever again!

  • I would expect most policies to cover that, but it depends on the fine print of the individual policy.
    The burden of proof would be on you too - its not good enough just to say you couldn't get there, you would have to be prepared yo back up your claim with official travel reports, pics of snowed in roads etc.

    Read the policy doc's before paying for anything, and if in doubt call them to confirm.

We have today had a burst water pipe at our shop. We are insured for our stock and our landlady is insured for the damage to the property etc. Alot of our stock has been damaged and ruined. We have notified our insurance (this is obviously a commercial policy). We have never had to make a claim before so I was wondering what is a good guide to how long they take to pay out? We cant reopen cos we need to replace what has been damaged so therefore we are losing more money?

It could take a couple of weeks before the settle the claim and a week to pay it. If it starts to take too long, consider hiring a "public claims adjuster" or "public adjuster" to assist in negotiating for you.

  • ~~This varies greatly from one carrier to another. With State Farm they assessed the damages and a check was written immediately. We also had a loss of business rider in our commercial package which paid all employees and average income loss in cases like this.

    You need to ask your agent this right away, and hopefully you also were covered with loss of business as well. Best of luck!!!

  • Take as many photos ,stills not digital and a video if you can. as you can of all the damage every where , take a full stock take of all damaged stock ,equipment , fixtures and fittings , personal property ,, every thing that is damaged . you need the photos as proof if you move any thing in a clean up , keep everything that you move , have all receipts for lost stock if food say and you just have to dump . this is proof of purchase , also you need a quote from a reg. contractor for all building repairs , you need to know how much NOW that all your equipment is going to cost ,,
    you need to tell a white lie here as to its age ,as the older it is the less you will get to replace it
    does your policie cover loss of trading .loss of wages for staff you, your family, your neighbours were they affected by your misfortune ? they will be claiming from you too. ? the accessor will be very prompt , but will be trying to get you to settle as fast and as cheap as possible.

    This is where you have to sit down and realise that you are only going to get one cheque to sort out this mess, YOU HAVE PAID YOUR HARD EARNED MONEY .FOR COVER ,NOW ITS PAY BACK ,JUST BE HONEST IN THE FIGURE , HE WILL TRY TO KNOCK OFF MONEY ,AND WILL HAVE ALL THE TALK ,BUT YOU NEED AS MUCH AS YOU CAN AND MORE TO GET BACK UP AND RUNNING .

If you have home owners insurance then they might cover the expense. However there is always a deductible often as much as $1000. Also most insurance companies now limit the amount they will pay on mold removal. Best to call your insurance company and discuss with them.

  • The drainpipe outside the building is not the cause of the water entering the house. There has to be a hole/crack/opening in the wall, the roof, a door, etc. that's causing the water to enter. So now we need to know what caused the hole/crack/opening to determine if it's covered (i.e. a branch putting a hole in the roof might be covered, eroded grout between bricks would not). The mould is not covered regardless. You can call your insurer, however you should investigate on your own where the water is coming from.

    storm & tempest if you have kept you building in
    a good state of repair.

    Black spots are fungus and do not happen in a week or so.
    If your drainpipe is broken then fix it.

    Your building insurance is not a maintenance scheme.
    From what you have said you are not covered in any policy.

Hi. I recieved a top for Christmas which doesnt fit (it is from New look). I have had a look at the shp for the right size but they don't have it. I lookked fopr anm alternative but there was nothing that i liked. I have managed to get hold of the reciept but it was payed for on a card so the card holder would need to be present to get a refund. Unfortunally the card holder lives about 200 miles away. Am i able to get a refund in cash. I dont realy want store credit as they dont have anything that i like in the shop. Thanks for any help.

you won't get a refund unless the top was 'not of merchantable quality' eg it was faulty

if it doesn't fit,then it only entitles you to an exchange for something the same value
or more, if you pay the extra

  • At this time of year this is normal. You have the receipt, just go in there and tell them the problem, you may get the money for it or store credit that can be used for anything, acessories, shoes etc. Fight your corner though.. and see what happens.

i manage holiday apartments in bulgaria and also provide services such as ski hire and lessons. the company is bulgarian registered
. i have a booking for a scout group and have been asked what public liability i have, after extensive research and also communicating with large insurance companies in sofia it seems it is simply not available so have none.
i would like this cover, is it possible to simply set up a uk company that could get this (is this possible) and contract it to the bulgarian company?
could the uk company own the bulgarian company?

  • I assume you are looking for contents insurance and not buildings insurance? You cannot get buildings insurance for a flat on it's own, this needs to be for the whole building and would normally be included in the service charge for the flat the management company imposes on you.

    For contents insurance there a myriad of options, try confused.com as a starting point.

    Incidentally as a tenant you are NOT required to get buildings insurance, that is your landlords responsibility.

  • I am with Age concern, maybe you are thinking of another Company, or maybe they only Insure older people, but I have £10,000 cover on contents only fo £5 per month. You would only need contents insurance anyway, not building also. Good luck.

My purse was lost or stolen last night ... had to cancel cards etc.?

I stupidly lost my purse last night, whether i misplaced it or it was stolen ... it doesn't really matter, basically it's gone.
The three most important things that I had in there were my student account card, my other account card and my drivers licence.
I'm going to drive to the place tomorrow and ask the pub and bar whether it was handed in (hoping for a miracle there really) but if it's not there, i'll need to do what?
Cancel the cards? What information do the banks need to know? Account number? Anything else?
And what about the drivers licence people? Something from my counterpart licence?

Sorry to hear about it but you should have cancelled all the cards as soon as you found you'd lost the purse by ringing the emergency numbers.
You should also have reported it to the police immediately.

The police will give you details of what to do and how, but you shouldn't wait until you go back to the pub, thieves don't!

  • hi there,
    well firstly , you should report them stolen as fast as possible , i would recommend that you did it now ,as it could be being used already(hopefully not)
    On the back of the credit cards and on your bills it will have an emergency hotline number to phone.
    You will have to say that you have just realised they have gone to help your case . ie , better not to tell them you knew they were stolen a while ago..You hopefully should be fine on that one ,especially if you hold insurance, in case of theft)
    They will ask you on the hotline for your name adress and probably a few security questions that you told them when you took out the account , like your mums maiden name etc..

    For your driving licence , if you have your counterpart you will have nothing to worry about- they will know all about who you are from a simple number that they will ask you for...once i lost all my driving docs and had to tell them the date and place i passed my test, which was 30 years ago , so not quite so simple..
    Sad and horrible and big nuicance when we have these accidents or losses but i shouldnt worry much about it. thers not much you can do , except let them know what ive said soon as poss. Before you know it it`ll all be back with you.

I was involved in a traffic collision in Nov 08. The other party has admitted liability. How long do these cases normally take to settle. I have ongoing back trouble since the accident and my GP has said I will just have to manage the pain with meds. I can never seem to get a straight anawer from my solicitor.

You can't get a straight answer from your lawyer....because there is not one.

The attorney has to order copies of all your medical bills/records. He can't say how long it will take to get that together. If it's one or two bills...it goes very quickly. If it's a lot....could easily take 6 months to get everything in.

Then the attorney has to review the information and submit it to the insurance company.

Once the insurance company gets the information...they review it. That could easily take up to 60 days.

If there is information mission from the settlement package....the insurance adjuster lets your lawyer know what they need.

The lawyer then gets that information and submits it to the insurance company.

Once all the information is in and both sides have reviewed the medical records....then negotiations begin.

In short....we can pull a number out of our ears and say "It should take 60 days" but that's complete garbage and a completely unreliable number.

Every claim is unique and has to be evaluated on its own merits.

There are just too many variables. No one can give you a solid number on how long it will take to resolve your claim.

  • I have a friend whose personal injury (multiple fractures of left leg) case took no less than 7 years to get settled ! Whilst being less than impressed with many solicitors, they do not have a crystal ball.
    During the processing of the claim there is much correspondence back and forth and this can take a substantial length of time. In my friends case the opposing solicitor took over 8 months to reply to one set of questions [which resulted in a formal complaint being made to the Law Society about him]. Your solicitor has no control over then length of time his opposite number takes to reply to correspondence.

after you file a claim on your policy. yes you can cancel your policy and get a refund on the premium based on the remaining period.

  • Yes you can cancel your policy, but you may find that you have to pay the full premium for the year. Check the small print on your policy documents. Insurance is an Annual contract and if a claim has been made during the course of that policy then you may not get a refund for the remainder of the policy term - in which case it isn't worth cancelling until the term is up.

  • Insurance pays for losses that occur while the policy is in force, so as long as you filed the claim during the coverage period the insurance company would be legally required to indemnify you. Whether or not that policy was still in force.

  • No. Once you claim you cannot cancel your policy. Also depend if Cooling period passed then you cannot cancel policy. Insurance compnay may refund if have not claim but all administrative expenses will be deducted.
